
Gift Card Terms and Conditions
§ 1 General provisions
1. These terms and conditions set out the rules for purchasing and using e-cards offered by the Kombinat.eu online store operated by the Seller.
2. The Seller and issuer of gift cards (e-cards) is Kombinat Konopny S.A. with its registered office at ul. Berylowa 7F, 82-310 Gronowo Górne, NIP: 5783144484, REGON: 387374060. The company is entered in the Register of Entrepreneurs of the National Court Register kept by the District Court in Olsztyn, 8th Commercial Division of the National Court Register, under KRS number: 0000864387, share capital: PLN 6,094,721.30 (paid in full).
3. An e-card is a form of electronic voucher that can be used to purchase products available in the kombinat.eu store, with the exception of other gift cards.
4. The purchase of an e-card constitutes acceptance of these terms and conditions.
§ 2 Definitions
• Gift card / e-card — an electronic voucher with a specific nominal value, issued by the Seller.
• Customer – Consumer — a natural person entering into a consumer contract, the subject of which is not directly related to their business or professional activity.
• Card balance — the current value of funds available on the e-card.
• Card order — placing an order for an e-card in the store.
§ 3 Purchasing a card
1. E-cards can be ordered via the online store as a product added to the shopping cart.
2. E-cards are available in denominations of PLN 100, PLN 150, PLN 200, PLN 250, and PLN 500 (or other denominations if the Seller decides to change the offer).
3. After placing the order and making the payment, the e-card is sent to the email address provided by the Customer within a maximum of 24 hours from the payment being credited.
4. Payment for the e-card is made in advance, before it is sent. Cards cannot be ordered on a cash-on-delivery basis.
5. After purchasing the card, without exercising the right to withdraw from the contract, it cannot be returned or exchanged for cash.
§ 4 Validity and use of the card
1. The e-card is valid for 12 months from the date of purchase (date of purchase = date of issue of the e-card). After this period, any unused funds expire.
2. The e-card is valid until the funds are exhausted and can be used multiple times. The amount can be used in one or more orders.
3. The card is not assigned to a specific customer. It can be used by anyone who has the card number and PIN. It does not have to be the person who made the purchase.
4. Any unused funds remain on the card for future purchases.
5. The e-card can be used to purchase any products available in the store, except for other gift cards.
6. If the value of the order exceeds the balance of the e-card, the Customer may pay the difference using another payment method available in the store.
7. E-cards can be combined with discount codes or promotions, unless the terms and conditions of the promotion state otherwise.
8. It is possible to pay with several e-cards at the same time.
9. In the event of a return of goods purchased with an e-card, the funds will be refunded to the same e-card.
10. For security reasons, after three incorrect PIN entries, the card will be blocked by the Seller. The Customer should then contact the Seller.
§ 5 Right to withdraw from the contract
1. As a consumer, the Customer has the right to withdraw from a distance contract within 14 days of purchasing the e-card. The deadline is based on consumer law and the practices of the store.
2. To exercise the right of withdrawal, the Customer must submit an unambiguous statement (e.g., by email to sklep@kombinat.eu or in writing to the Seller's address) before the expiry of the 14-day period.
3. In the event of a valid withdrawal, if the e-card has not yet been used, the Seller shall refund the amount paid, using the same payment method that the Customer originally used.
4. If the card has been partially or fully used, the right of withdrawal does not apply.
§ 6 Complaints and reporting procedure
1. All complaints related to the e-card (e.g., activation problems, shipping errors, non-receipt of the card) should be reported by contacting the store: e-mail address sklep@kombinat.eu
2. The Seller will make every effort to respond to the complaint within 14 days of receipt.
§ 7 Liability, limitations, and ownership rights
1. The e-card and the funds remaining on it are the property of the Seller until they are used. They are not cash or a financial instrument exchangeable for cash outside the store.
2. The card and the funds on it may not be sold, exchanged, transferred to third parties for commercial purposes, or used for cash exchange.
3. All intellectual property rights (e.g., store software, website layout, database) belong to the Seller or its licensors. The e-card does not grant the right to use these materials outside of purchasing products in accordance with the terms and conditions.
§ 8 Amendments to the Terms and Conditions
1. The Seller reserves the right to amend these Terms and Conditions at any time.
2. Amendments shall come into force upon their publication on the store's website and shall apply to future cards. E-cards purchased before the amendment shall be subject to the terms and conditions in force on the date of purchase.
§ 9 Final provisions
1. Contracts concluded using e-cards are concluded in Polish and are subject to Polish law.
2. In the event of disputes, if the Customer is a consumer, consumer law provisions shall apply.
3. In matters not covered by these regulations, the provisions of the Kombinat.eu store regulations and generally applicable law shall apply.
4. The gift card terms and conditions are publicly available on the store's website and can be downloaded/printed by the customer.
